Hutch Man Convicted of Selling Half Pound Of Marijuana Granted Corrections

A 30-year-old Hutchinson man who entered guilty pleas in a marijuana case was sentenced Friday to 100-months in prison, but was then granted 36-months community corrections. However, Kenneth Boyer as part of the community corrections, he will have to serve 60-days in the county jail. Judge Chambers making the point that these are serious offenses and there should be some jail time.

Boyer had entered pleas for the sale of marijuana, possession of marijuana with intent to sell, and two counts of no tax stamp. The state agreed to not file an additional case of the sale of marijuana, but did request prison time of 51-months, considerably less then the judge ordered in the case.

The case centers on Boyer meeting with an undercover detective in the parking lot of Family Video at 30th & Severance in the late evening of August 19. He sold the detective a half pound of marijuana for 500-dollars. He was then arrested and allegedly told detectives that he had more pot at his home and took the officers there where allegedly he had another 392-grams of marijuana which was found in four different baggies.

Boyer was then arrested for another case of possession of marijuana, possession of drug paraphernalia and disorderly conduct about the time he entered the pleas. But, the new arrest didn’t effect the plea deal in the other case. Allegedly Boyer had two pipes on him at the time of his arrest.
