HUTCHINSON, Kan. – The defense for a woman charged with unlawful sexual relations with an inmate while employed with the Kansas Department of Corrections.
Angela McCurtis is charged with a single count of unlawful sexual relations with the inmate who the state says was over 16-years of age at the time of the crime. There are some juveniles that are incarcerated in adult prison even though they are juveniles. The alleged encounter occurring between July 1, 2011 and July 26, 2011, but the complaint wasn’t filed until September of last year.
McCurtis was arraigned on the charge last month and entered a “not guilty” plea. The defense wants statements made by the victim. According to court documents, the inmate only identified at “W.H.” denied any sexual encounters in early interviews with investigators in this case, but also showed concern about receiving a disciplinary report if he cooperated and possibly loose his good time credits and prolong his sentence. He was eventually promised that this wouldn’t happen and after that, he admitted the sexual encounter occurred. The defense believes the statements by the alleged victim were coerced and want those statements suppressed.
Judge Trish Rose set a hearing on the motion for August 21, however she tells us that this is scheduled during her Friday morning criminal docket. Normally, those types of motions are heard separate from any docket, so that date or time may change.
The case is scheduled to go to trial in October.
