Hutch man enters plea in attempted murder case

HUTCHINSON, Kan. — A Hutchinson man scheduled to go to trial this week in an attempted murder case avoided the jury trial when he entered a plea to a reduced charge Monday morning.

31-year-old John Cantu entered a plea to conspiracy to commit aggravated battery in front of Judge Tim Chambers, meaning he avoids the more serious charges including attempted 1st degree murder.

The case against Cantu involves six men going to the home of Jeffrey Payne back on February 18, 2013, forcing their way into his home and beating, then stabbing him 23-times. Payne nearly died from his wounds.

Judge Chambers set sentencing for June 27. The conspiracy charge is a level 6 felony with a sentencing range between 40 and 46-months in prison. Both sides will be able to argue disposition in the case.
