A 34-year-old Hutchinson man accused of two alternate counts of felony flee and elude for a 2012 case was found “not guilty” Tuesday after a brief trial in front of Judge Trish Rose. They got the case against Kenneth Hamilton this morning after both sides gave closing arguments.
Kenneth Hamilton was charged in the case after he allegedly failed to stop for a law enforcement office back on September 19, 2012. The officer allegedly had suspicion that he may be driving with a suspended license and attempted to stop an individual on a motorcycle as he was leaving a plant in South Hutchinson. The officer then tried to catch the man, but the rider was able to loose the officer.
He was later charged by the state with the two alternate counts of felony flee and elude, and two misdemeanor counts including driving while suspended and illegal tag.
But, the defense argued Tuesday that the South Hutchinson Police Officer couldn’t identify the person on the motorcycle the day of the chase as the defendant. The officer described the suspect as wearing dark clothing when in fact, the person shown in the video that the jury got to see had a gray shirt and light khaki pants.
Again, Hamilton found “not guilty” in the case.
