Hutchinson Man Bound Over For Trial On All Counts In First Degree Murder Case

A Hutchinson man accused of first degree murder was finally bound for trial Tuesday after a lengthy preliminary hearing in front of District Judge Joe McCarvile.

The case involves Michael Brisco who is charged with two alternate counts of murder for the shooting of 26-year-old Sem Adrien back on September 9, 2013. One is for premeditated first degree murder and the alternate count is for intentional second degree murder. Other charges include criminal possession of a firearm, aggravated intimidation of a victim or witness, possession of methamphetamine and solicitation to commit perjury.

The state believes they showed probable cause while the defense argued differently stating that there was no consistency to testimony of witnesses and what they saw the night of the murder. Defense Attorney Alice Osburn argued that at best the first count would be voluntary manslaughter and that if her client committed the shooting, there’s no evidence to support that it was premeditated or intentional. She also told the judge that there was evidence that the meth located in the home belonged to Kristina Edwards. She also argued that there is no evidence of him soliciting perjury.

But, Judge McCarville says that the victim had two wounds to the heart and appears he was shot as he tried to leave or flee. He says the defendant was angry before and after the shooting and believes there is probable cause that he committed the shooting. He says there is also some indication of the intimidation when he told others in a vehicle with him after the shooting that if they talk to the police, “his business may not be done.”

Its appears that he had the gun at some point after he allegedly hid it then tried to give Edwards hints on where he hid it. There were also spent shells found in a empty cigarette pack in the trash at his home that matches the brand he smokes.

The judge also believed that he may have convinced Edwards to come to the Law Enforcement Center to confess to the crime to get Brisco off the hook.

The final witness for the state was Hutchinson Police Detective Jamie Schoenhoff who told of two interviews with the defendant, one before his arrest and the other right after. He told of how in the initial interview where he denied any knowledge of the shooting and the second one where he admits it happened when he was around but tried to blame it on another man, Lorenzo Hester. You may recall that Hester was on the stand Monday and denied he had any involvement with the shooting saying Brisco and Edwards were the two outside at the time of the shooting. The detective also asked him if he had a killer mentality and Brisco allegedly told him, “yes” write that down.

With Brisco being bound over as charged, he’ll be arraigned on the charges next Monday.

Deputy District Attorney Tom Stanton says based on the length of the preliminary hearing the trial could last as long as three weeks and is scheduled for May.
