A Hutchinson woman arrested after Kansas Parole along with Hutchinson Police did a search of a adult video store and allegedly found drugs was bound over for trial Wednesday even though the defense tried to contend that law enforcement may have not had probable cause.
Wanda Loveless “aka” Wanda Logsdon, was charged with possession of methamphetamine, no drug tax stamp and possession of drug paraphernalia, however the state dropped the tax stamp charge because the small amount found.
The violation of her parole for an armed robbery conviction in Texas led to the search after the parole office became convinced that her urine analysis or UA’s had been tampered with. The local parole office began supervising her after she moved to Kansas.
The search of the “Spice It Up” video store and her nearby home back in September led to the discovery of the drugs in the business, as well as a glass pipe. The amount of drugs was .77-grams which is personal use amount. Loveless at the time denied she even knew the drugs were there.
Defense Attorney Charlie O’Hara questioned whether they had probable cause to search the business, but parole officers testified that as a part of parole, they have the right to search anything a parolee has control over and that would include the business that she owned and operated.
Magistrate Judge Randy McEwen found there was probable cause and sent the case to District Court Division 1, for arraignment. That will be in front of Judge Trish Rose on February 3.
You may recall that her son, Charles Christopher Logsdon was convicted of murder for the shooting death of Jennifer Heckel in June of 2011, and sentenced to roughly 73-years in prison. He was also sentenced last Friday for an aggravated battery conviction, however that sentence will run concurrent to the sentence in the murder case.
