The 21-year-old Hutchinson man police say broke into a home and inappropriately touched a 10-year-old girl and two 9-year-old’s was in court this morning, but still has not been formally charged by the state.

Tyler Ford was arrested for aggravated burglary and three counts of aggravated indecent liberties with a child. But Assistant District Attorney Andrew Davidson says that his boss, District Attorney Keith Schroeder is still contemplating whether to file the charges of aggravated indecent liberties.

Apparently the burglary and touching of the girls happened when the kids were in bed.

The girls’ father chased Ford from the home and police later found him walking in the area, then found his cell-phone in the child’s room. He was unknown to the family, but apparently lives within a block of their home. This all occurring back on Sunday September 15.

Wichita Attorney Alice Osburn was assigned to the case, but was not in court on Wednesday.

Magistrate Judge Randy McEwen set another status hearing in the case for next Monday at 10 a-m.

Ford has been on community corrections for burglary from August of 2012, and a burglary and theft from January of this year.
