One of the six suspects who entered guilty pleas in two cases, one of which involved the attempted murder of a Hutchinson man is scheduled to be sentenced Friday.
Desmund Cantu entered guilty pleas to aggravated battery, two counts of aggravated burglary and aggravated assault. All other charges including attempted 1st degree murder were dropped by the state as part of a plea agreement.
He is the only one of the six to enter into an agreement with the state so far.
Joseph LeShore is also scheduled for court Friday for a status hearing on the charges against him in association with the attempted murder case.
The other suspects accused with the beating and stabbing of Jeffrey Payne also includes Jordon LeShore, John Robert Cantu, Troy Bell and Sean Arevalo-Mendoza.
Last Friday, a defense motion to continue the trial of Jordon LeShore was granted with no objection from the state. The judge set a new motions deadline of October 4, in his case but didn’t set a new trial date.
Also last Friday, the attorney for one of the other six suspects in an attempted murder case was seeking to get the charges dismissed against his client because of his belief that there is lack of probable cause.
But, the state asserts that the attorney for Arevalo-Mendoza had filed the motion out of time and shouldn’t even be considered. Attorney Ben Fisher told the judge that he was told all motions were to be filed by August 30. Judge Chambers took all of that under advisement.
The attack on Payne occurred back on February 18, when the these suspects allegedly broke into Payne’s home and physically attacked and stabbed him numerous times in the leg and torso.
