HUTCHINSON, Kan. — A 22-year-old Hutchinson man convicted of possession of marijuana with intent to distribute and possession of marijuana with intent to plant or grow marijuana is back in jail for criminal possession of a firearm.

David B. Terry is alleged to have been in possession of a firearm, that being a Taurus PT709 9mm handgun, when contacted by law enforcement back on March 5.

Initially after the arrest, the state declined prosecution in the case, however, the charge has now been refiled.

There was some question in court whether he had posted the $5,000 bond after being arrested initially in this case. He’s currently serving a seven-day sanction for violating his corrections in the marijuana case.

He’s expected back in court May 18 on the new case as part of a waiver-status docket.
