Special hearing will be held next Wednesday in 2013 murder case

HUTCHINSON, Kan. — The case against a Hutchinson man accused of murder was before Judge Tim Chambers Friday for a pretrial hearing

The trial for Michael Brisco is scheduled to begin next month, however there was some concern on the part of the defense that some items being redacted by the state might not be done in time for them to review. This came up two weeks ago and came up again Friday.

Defense Attorney Steve Osburn brought up the issue saying its his wish that the state not be allowed to use the video and audio at trial, but says if it is allowed, he hasn’t received some from the state. Deputy District Attorney Tom Stanton says Osburn should have all but two and those should be complete by next week.

He told the judge that he thinks the problem for Mr. Osburn is that he has a heavy trial schedule making it hard for him to view the C-D’s he has. Osburn indicated that he has 97 so far, 13 that have been redacted.

After hearing the two sides arguments, Judge Chambers decided to have a special hearing so they can work through all of these issues. That will be next Wednesday at 9 a.m.

Brisco is charged with murder for the shooting death of 26-year-old Sem Adrien back on Sept. 9, 2013. Other charges include criminal possession of a firearm, aggravated intimidation of a victim or witness, possession of methamphetamine and solicitation to commit perjury.
