HUTCHINSON, Kan. — A 51-year-old man charged in a case with his son in a marijuana cultivation case waived his right to a preliminary hearing on an amended charge of obstructing apprehension of prosecution. He then entered a “guilty” plea to the single charge.
Johnny Payne was charged with cultivation of marijuana, conspiracy to cultivate marijuana, possession of drug paraphernalia with the intent to cultivate marijuana and personal use drug paraphernalia. He was arrested along with Jonathan Payne back on Nov. 23, 2014 on theses charges.
Drug Unit Detectives are alleged to have found 12 marijuana plants at the home in the 1500 block of North Monroe.
But in court, Deputy District Attorney Tom Stanton indicated that plants were for his son Jonathan Payne but alleges that Johnny Payne attempted to hide evidence for his son.
With him entered the plea, sentencing will come on Aug. 7.
The charges in a number of cases including this one filed against Jonathan Payne are still pending.
