HUTCHINSON, Kan. — The 36-year-old Partridge man convicted after he allegedly entered a home and other properties without permission was denied a downward departure.
Lucas Willhite was convicted aggravated burglary and burglary in the case and prior to sentencing apologized to the victims and told Judge Trish Rose that everyday he regrets his actions.
His arrest coming after a number of reports in December of last year of him entering properties or attempting to enter properties without permission. One of the victims spoke to the court Friday saying that Willhite entered a home while his daughter was asleep and alone in the home.
Judge Trish Rose agreed with the state that these crimes can have a severe effect on the victims. She told him that she can’t find any substantial and compelling reasons to depart saying the effects on the victims can be life lasting and ordered him to prison for just over four years.
