Motion to suppress hearing in assault case in recess
HUTCHINSON, Kan. — A 33-year-old Hutchinson man who was arrested back in November after an altercation where he allegedly pointed and discharged a gun was in court Monday over whether the victims identification of him should be suppressed at trial.
Nicholas Espinoza is charged with aggravated assault, criminal possession of a firearm, possession of marijuana and drug paraphernalia.
The defense argues that Espinoza denies he ever pointed a gun at Jennifer Rutan or anyone else. He admitted that there was a gun in the home, but that in belonged to someone else.
He was arrested after Rutan told police that a Hispanic male pointed a gun in her direction as she and her husband drove west on a south side Hutchinson street. They argue that at no time after the incident did Rutan return to the scene to identify Espinoza as the one who pointed the gun at her and was never shown a lineup to determine if they had arrested the right person. It wasn’t until the preliminary hearing that she made the identification.
Espinoza is also alleged to have fired the gun in the air at some point. A volunteer officer heard a gunshot while in the area. They reportedly found a spent 40-caliber shell outside the home of Espinoza in the 100 block of East Campbell.
An officer did take the stand on Monday over the investigation, but the victim was unable to be in court Monday because of a sick child, so the hearing is now in recess until Jan. 12.
Espinoza has previous felony convictions for drugs going back to May of 2011 that makes it illegal for him to have any type of weapon.
Hutchinson man scheduled for preliminary hearing Tuesday
HUTCHINSON, Kan. – A 33-year-old Hutchinson man is expected in court Tuesday for a preliminary hearing over his arrest for drugs after he was stopped in the 700 block of North Adams.
Jeremy Frischenmeyer is alleged to have been in possession of methamphetamine, marijuana and simulated substances at the time he was stopped by police.
He was apparently at an apartment in the 200 block of West 8th, where he was apparently not welcome. He was arrested on the drug charges and also advised of criminal trespass for being at that apartment. This occurring back in July.
On June 30, he was released from prison for three burglary convictions going back to 2011. But, he also has other convictions for burglary, forgery, theft and possession of drugs.
He remains jailed on a $13,000 bond.
Shoplifting incident leads to two arrest
HUTCHINSON, Kan. – After an employee of Kohl’s Department Store reported two individuals were shoplifting at their store on Friday, it led to one of them being arrested on other charges.
29-year-old Aris L Dehart, of McPherson was arrested for theft, felony interference with law enforcement, possession of methamphetamine and possession of drug paraphernalia. She made a first appearance Monday where Judge Trish Rose lowered her bond to $2,500.
19-year-old Erick Farrell of McPherson as arrested for theft and he was able to post a $500.00 bond and will make a court appearance at a later date.
