Salvation Army thief granted community corrections

HUTCHINSON, Kan. – A 52-year-old Hutchinson man convicted for two counts of theft for stealing from the Salvation Army and a third charge of criminal trespass was granted one year of community corrections.

Judge Trish Rose sentenced Kenneth Weis to one year in prison, then granted the corrections, even though the state had sought prison time. The case is presumptive probation but they wanted the prison time because of him being convicted of doing the same thing in the past.

Weis was convicted of taking items donated to the Salvation Army from their drop off boxes near the building at B & Main.

The thefts occurred on three different occasions, November 22, 2012, and April 28, and May 19, 2013. Although the items taken have a value of less then a thousand dollars, the state still filed the charges as felonies because the defendant having two or more prior convictions for theft, including one where he also stole items from the Salvation Army previously.
