HUTCHINSON, Kan. — The man arrested after a high-speed chase in Reno County earlier this month appeared via video from the Reno County jail Wednesday morning where he was read the formal charges against him, not involving the chase, but the incidents surrounding his capture.
It was back on October 12, when police got information that he was hiding in an attic of a residence located at 415 East B. Officers responded to the home and established verbal contact with him, but he refused to comply and soon set a small fire in the attic. With the assistance of the Hutchinson Fire Department and the Reno County Sheriff’s Office, officers gained access to the attic and placed Lutz into custody without incident.
The state has charged him with a felony count of aggravated arson and two additional misdemeanors. That being interference with law enforcement and battery of a law enforcement officer.
The aggravated arson charge is a level 3 person felony with a sentencing range of four and half years to over 20 years in prison, depending on his criminal history. He also faces violations of his previous convictions which could see him get prison time there as well.
Bond in the case is set at $172,500, and he’ll be back in court on November 4, as part of a waiver-status hearing.
Lutz has previous convictions here in Reno County for obstruction, unlawful manufacturing or attempting to manufacture meth, possession of drug paraphernalia, possession of effedrine, robbery and criminal damage to property. He also has a conviction for felony flee and elude for a case out of McPherson County and convictions from Russell County going back to 2008.
