Some witnesses in kidnapping case fail to show for hearing

HUTCHINSON, Kan. – The preliminary hearing for a man accused with some serious felonies was scheduled for this morning and everyone showed up in court including the defendant and his attorney, the judge and the prosecutor, but some of the state witnesses didn’t.

Senior Assistant District Attorney Steve Maxwell then requested a continuance in the case against James Dean to give them time to learn if the witnesses had been served subpoenas. The defense objected saying they were ready to proceed. Judge Joe McCarville reluctantly granted the states request telling the defendant that if he dismissed the case, the state would probably refile the case and he would be arrested again.

In this case, Dean faces charges of aggravated kidnapping, aggravated burglary, aggravated battery and criminal possession of a firearm, which allegedly was a 9 mm, handgun.

He’s accused of going to the home of 50-year-old David Crossman, entering the home uninvited, forcing the victim from the home and then beating him with a baseball bat. This occurring back on February 28.

The hearing in this case is now set for May 22.

In the other case he’s scheduled to go to trial on June 17 which is a case where he is accused of stabbing a man and running over him with his own truck. That allegedly occurring in the early morning hours of August 4, 2013.
