A Mulvane area man found “guilty” of aggravated sexual battery was sentenced Thursday afternoon in Reno County District Court to 32-months, or 2-years, 8-months in prison.
That was the decision of Judge Tim Chambers for Jodie Mosier which went against the state request for 34-months and against the defense who wanted probation.
The request for a border box finding or durational departure by the defense was denied by Judge Chambers. He also denied defense motions for judgment of acquittal, request for a new trial and arrest of judgment.
Mosier had been accused of raping or attempting to rape the victim, but the jury found him “not guilty” on those charges.
The crime of sexual battery occurring on the 32-year-old victim at M&M Point at Cheney Lake back on May 30, 2010. The state argued that it was deliberate act when he took pictures of the victim while she slept during a camping trip.
Mosier still faces criminal case in Sedgwick County involving the same victim and her daughter for allegations involving rape and inappropriate touching of a small child in Sedgwick County.
Judge Chambers did set an appeal bond of 250-thousand dollars. The state requested that it be doubled while the defense argued that he’s been on bond supervision for two years with no problem, and at the very least wanted it reduced. Judge Chambers denied both request saying he raised it 5-times the original bond of 50-thousand dollars and says he thinks the bond is appropriate. Mosier was taken to the Reno County Jail until he can post the bond.
