Wichita Man Sentenced To 35-Months In Domestic Case

A 51-year-old Wichita man involved in a domestic incident which occurred in the Cheney Lake area last summer and entered “no contest” pleas to two of four charges against him was sentenced to 35-months in prison by District Judge Tim Chambers.

Anthony Cruz had been charged with two counts of aggravated battery, aggravated endangering of a child, and criminal damage. He entered the pleas to one count of aggravated battery and endangering a child.

Judge Chambers gave him 30-months for the aggravated battery and another 5-months for the endangering a child conviction and ran the sentences consecutive even though the original plea agreement called for concurrent sentencing. Apparently something in the law requires the sentences run consecutive. Senior Assistant District Attorney Steve Maxwell suggested that the judge could honor the agreement but finding manifest injustice, but the judge declined.

Cruz was convicted of ramming his vehicle into another during a domestic altercation at the lake back on August 19. Apparently there was a child in the victims vehicle at the time of the incident.

Cruz will get credit for time served in the Reno County Jail and any good time credit while in prison.
