The Kansas Supreme Court has rejected the appeal of a 31-year-old Hutchinson man convicted of rape and two counts of aggravated indecent liberties with a child.
Robert Miller had been convicted of the crimes which occurred in January of 2009 and appealed the three concurrent hard 25 sentences saying those sentences amounted to cruel and unusual punishment.
The case centers on three young girls who made separate statements to their mothers and then to investigators that Miller had engaged in sexual conduct with them by touching them in their private parts in an inappropriate way. The girls were 4, 5 and 7-years of age at the time of the crimes.
Miller also challenged the convictions arguing that the state failed to present sufficient evidence at trial to prove the various alternative means of committing each crime. The high court rejected that argument as well. They affirmed the convictions and sentence.
So, Miller will serve at least 25-years before he will be eligible for parole.
