We may find out Friday where things stand for a man bound over for trial in two cases of three cases against him.
36-year-old Joshua Rund was bound over for trial in a case going back to August 13, 2012, when drug unit detectives served a search warrant on his home at 3 North Kent Rd., over him allegedly firing a rifle. It’s illegal for him to have guns because of a previous felony conviction. They found the 22-rifle and three handguns. The rifle was found under the couch and the handguns in a safe. They also allegedly found marijuana leading to another search warrant being served and they found marijuana in two places as well as methamphetamine. Rund’s wife, Ellen claims everything was hers including the guns and drugs. She also claimed she never saw Josh shoot the gun.
Rund was also bound over in a the another case involving his failure to register as a drug offender back in November of 2012.
He’s scheduled for a status hearing on these two cases Friday to see if they will be headed to trial.
And after a Judge dismissed a third case against Rund, the state has refiled the charges.
He was arrested on September 6, 2013, for charges of criminal possession of a firearm, possession of methamphetamine, possession of marijuana and possession of drug paraphernalia. His 32-year-old wife, Ellen was also arrested. The two had allegedly gotten a room at 2605 East 4th, but were arrested in the 1100 block of East 11th. But, the state did not show any evidence that they had rented the room or that the couple was even in it. So, Judge Joe McCarville dismissed that case without prejudice and the state refiled the charges meaning there will be another preliminary hearing where the state is expected to present more evidence that shows they were staying in that motel room.
That case is still pending in front of Judge McCarville.
