A Hutchinson man convicted for the murder of a Hutchinson woman and sentenced to 73-years in prison was in court Friday over another criminal case where he entered a plea to aggravated battery.
Charles Christopher Logsdon admitted that he shot a Eric Harbacek in the leg after an altercation on November 26, 2010. He entered a “guilty” plea on the charge.
The shooting happened at the home where Logsdon was living at 108 South Severance. The victim was reportedly arguing over prison stuff with another man sitting on the couch with him and Logsdon shot him in the leg. In court, Friday there was comments that Logsdon was trying to get Harbecek to leave the home and that the victim may have insulted him. They also indicated that the victim may have been the aggressor when the shooting occurred.
Both the state and the defense agreed on a sentencing recommendation of 56-months and Judge Tim Chambers went along with the recommendation. He also agreed with the two sides recommendation that the sentence run concurrent to his life sentence in the murder case.
The victim apparently did not go to the hospital for treatment until the next day after on an off duty officer learned of the wound and suggested he get treatment. The victim had testified that they had to dig the slug out of him. The entrance scar he showed at the preliminary hearing appeared to be about 3/8′s of an inch, and the exit scar was about 3/4′s of an inch. It was at the hospital the next day that police got involved in the case. He was apparently very intoxicated and was belligerent at the hospital.
Logsdon is already serving the 73-year sentence for the murder of Jennifer Heckel which occurred on June 14, 2011. A co-defendant in the case, Billy Craig Jr., is still awaiting trial in the case.
