Father And Son Both Now Sentenced To Prison In Marijuana Distribution Case

The father and son arrested back on June 20, of last year on charges associated with the sale of marijuana will both serve time in prison.

54-year-old Gary Sage was sentenced Friday morning to 60-months in prison for possession of marijuana with intent to sell within a thousand feet of a school and 60-months for the sale of marijuana.

He along with his son, 24-year-old Austin Sage were arrested in the 1400 block of Eastland for allegedly being in possession of a sellers quantity of marijuana. According to the complaint, they had at least 450-grams, but less then 30-kilograms of pot. In court, Deputy District Attorney Tom Stanton told the court that he attempted to sell a undercover detective 1-pound of marijuana and the two had three pounds on them, as well as more inside their residence.

Defense Attorney Stan Juhnke asked for community corrections as along with a durational departure, but Stanton wanted the mid-range sentence of 158-months. Judge Chambers ordered the 60-months in prison as a departure from the guidelines. Gary Sage has prior convictions for selling drugs and didn’t buy his argument that he would never break the law.

Austin Sage was also sentenced to prison according to Stanton. He was convicted on three counts of distribution of marijuana, possession of drug paraphernalia and no tax stamp. He was sentenced back on September 27, by Judge Trish Rose and is eligible for parole on April 15, 2016.
