Jury Issues Mixes Verdict In Reno County Rape Case

The jury found a Mulvane area man “not guilty” of rape or the alternate count of attempted rape, but did find Jodie Mosier “guilty” of aggravated sexual battery.

The jury got the case against Mosier around 11:20 a-m, Thursday morning and had a verdict around 4:40 p-m.

He had been accused of raping or attempting to rape the victim, committing a sexual battery and taking pictures of the victim when she should have had the expectation of privacy. These alleged crimes occurring on the 32-year-old at M&M Point at Cheney Lake back on May 30, 2010.

The defense argued that the alleged victim didn’t report the incidents when they occurred and only did after it was clear that her mother and the defendant were going to get a divorce. They also argued that there is no proof on who took the pictures of the victim, but the state argued that it was Mosier because it matches the phone he had at the time, a Blackberry 95-30 and the pictures had been loaded to his computer two days after the alleged incident. They were found by Wichita Police while investigating similar allegations in that city.

Sentencing here in Reno County is set for February 7. Mosier was taken into custody until he can post a 50-thousand dollar bond.

He also faces criminal charges involving the same victim and her daughter for allegations involving rape and inappropriate touching of a small child in Sedgwick County.
