The trial for a former Mulvane area man accused in a case here in Reno County on charges of rape, aggravated sexual battery and breach of privacy is underway in Reno County District Court.
Jodie Mosier is accused of taking pictures of the victim when she should have had the expectation of privacy. This alleged crime occurring at the same time as the rape and sexual battery of a then 32-year-old woman at M&M Point at Cheney Lake back on May 30, 2010.
On the stand Tuesday afternoon was Wichita Police Detective Virgil Miller, who works in the Exploited and Missing Child Division of the Wichita department. He testified on the investigation into the case and says they seized the defendants computers and allegedly found evidence of the crime of rape here in Reno County. That included photos of the victim, when and where they were taken, which indicates Cheney Lake. Miller says they believe the photos were taken using a Blackberry phone at the lake.
The victim apparently had been drinking at the lake and may have passed out, and that’s when the alleged sexual assault occurred. Miller testified that this all occurred during an extended family camping trip over Memorial Day weekend.
The case is being tried in front of Judge Tim Chambers and continues Wednesday.
