A Hutchinson man who runs “Pampered Paws” in Hutchinson and facing trial on a charge of “felony breach of privacy,” wants the case tossed out. .
Terry Bryan is alleged to have placed a tanning bed in storage room inside the pet grooming business, then also installed a hidden camera in the room. He then allowed employees to use the tanning bed. The camera was allegedly attached to his computer in his office where the state alleges he could view what was occurring. This allegedly occurring back on September 19, 2012.
But, the defense claims the state failed to show probable cause that the camera was used for anything alleged. Through his Overland Park attorney, Thomas Bath, the motion indicates that police examined the camera which was a simple plug in, wireless camera, capable of supplying a live feed from storage room. According to the defense, they could not find that the camera was recording. The defense also claims that Bryan was not present when the alleged victim was in the room using the tanning bed. Detectives did say that it was connected to Bryan’s Computer in his office, but that nothing had been recorded.
They believe that the state failed to show probable cause at the preliminary hearing that Bryan did any of the things alleged, in fact they claim the state showed just the opposite. The state disagrees as did the judge who found there was sufficient evidence to send the case to arraignment and a possible trial.
Judge Trish Rose after hearing arguments on the motion took the matter under advisement and is expected to issue a written opinion in the near future.
