A 36-year-old man facing charges for the manufacture of methamphetamine is asking the evidence in the case suppressed.
Ryan Peterson is charged by the state with manufacture of methamphetamine, or in the alternative, attempt to manufacture meth. He’s also charged with possession of ephedrine, lithium metal, anhydrous ammonia all with the intent to manufacture and possession of stolen property, that being a stolen Lincoln welder.
The case starts on June 6, 2012, when law enforcement and firefighters arrived at a residence at 8806 S. K-17 Highway for the report of a vehicle fire. The vehicle parked in a driveway and not within the garage nor covered by any structure. They managed to put the fire out quickly. The defense contends they entered a garage without a search warrant to ensure there was no damage to the structure or hot-spots within the garage. They then allegedly found items consistent with the manufacture of methamphetamine. The defense argues they didn’t have probable cause and that all evidence based on them entering the garage should be suppressed.
A hearing on the motion to suppress was scheduled for Monday in front of Judge Trish Rose, but continued by the state to next month.
Peterson is no stranger to law enforcement having been convicted of possession of drugs, paraphernalia and possession of ephedrine and unlawful manufacture. Those crimes occurring in February of 2006.
