The 36-year-old Hutchinson man accused of shooting an Illinois man back on September 9, was read the formal complaint when he appeared in court Wednesday morning.
The state has filed two alternate counts of murder against Michael Brisco, one being first degree premeditated murder and the other a charge of second degree murder. Other charges include criminal possession of a firearm, possession of methamphetamine and aggravated intimidation of a witness.
Deputy District Attorney Tom Stanton again ask the court to increase the bond for Brisco to 1-million dollars. He alleges that the defendant may have threatened others who might give info to investigators. But, Defense Attorney Sam Kepfield argued that it gets to appoint that a bond amount is just a number, it doesn’t mean anything. He says his client can’t make the bond now and believes its appropriate. He says he would have to come up with over 50-thousand dollars to be able to post bond. He says he doubts any bonding company would allow him to make payments on that amount. He says he may file a motion to reduce the bond at some point. The bond currently sits at 501-thousand, 500-dollars and Magistrate Judge Randy McEwen told Kepfield that numbers do matter and are important. He says because of the additional charges being filed by the state, he increased the bond to 700-hundred thousand.
Kepfield has apparently filed a motion for discovery, but Stanton told the court that he should be granted the usual statutory discovery at this point. That was granted by the judge.
Brisco is charged for the killing of 26-year-old Sem Adrien. He was found suffering a gunshot wound in a small parking lot at 8th & Plum. He was taken to Hutchinson Regional Medical Center where he was then pronounced dead.
It appears that Brisco will remain in custody for the foreseeable future and his next court appearance will be on October 16, in front of Judge Joe McCarville.
