HUTCHINSON, Kan. – A 25-year-old man who was arrested on a number of charges back on April 17 was in court Friday morning for a first appearance.
Tracy Roberts faces potential charges possession of marijuana, possession of mushrooms, possession of drug paraphernalia to manufacture or grow illegal drugs and personal use drug paraphernalia.
Police apparently went to the residence in the 500 block of East 9th, on a warrant check. Roberts apparently had some outstanding warrants for both District and Municipal Court.
When the door to residence was opened, officers allege that they could smell marijuana and also saw some bongs in plain sight. They eventually obtained a search warrant and allege that they found items consistent with the use of drugs including marijuana and illegal mushrooms. Also found items police allege was used to cultivate or manufacture drugs.
In court, Roberts who’s free on bond downplayed all of this saying at best any charges should be misdemeanors. Magistrate Judge Cheryl Allen told him that he may think the charges should be misdemeanors, but the state may think differently.
He’s expected back in court on April 29, for the reading of any formal charges.
