After a 52-year-old former Mulvane area man had been bound over in Reno County on charges of rape, and aggravated sexual battery and an additional count, that being “breach of privacy,” the defense requested this morning that the judge reconsider that charge.
The new charge alleges that Jodie Mosier took pictures of the victim when she should have had the expectation of privacy. This alleged crime occurring at the same time as the other charges where he’s accused of the rape and sexual battery of a then 32-year-old woman at M&M Point at Cheney Lake. This occurring back on May 30, 2010.
The case starts with her notifying law enforcement officials in Sedgwick County who then seized his computers and allegedly found evidence of the crime of rape here in Reno County. Officials here then began their investigation leading to Mosier’s arrest.
The victim apparently had been drinking at the lake and passed out, and that’s when the alleged sexual assault occurred.
Judge Joe McCarville back on May 9, agreed with the state that there was probable cause to bind Mosier over for trial on the additional count. Judge McCarville after hearing arguments for and against the additional charge decided to stick with his original decision, so Mosier will face trial on all the charges filed by the state in the case.
