HUTCHINSON, Kan. — A 49-year-old Hutchinson Correctional Facility inmate’s efforts to stay in Kansas failed after he appeared before Judge Tim Chambers.
Robert Lee Oatis is wanted in Virginia for a charge of aggravated sexual battery. He is arguing a Habeas Corpus motion where he claimed unlawful arrest or detention. The claim was denied by Judge Tim Chambers, who indicated that everything in the Governor’s warrant out of Virginia was in place.
Oatis is serving time in Kansas for attempted rape, attempted burglary and aiding a felon in 1990 out of Douglas County. He is not eligible for parole in Kansas until 2019.
With the decision Wednesday, authorities from Virginia are free to come get him and take him back to that state.
