One of two formally charged in marijuana cultivation case wants evidence suppressed

HUTCHINSON, Kan. — One of two people charged in a case from last year wants some of the evidence against her suppressed.

Darla Conners and John Galestine are both charged with the cultivation of marijuana, that being 100 or more plants as well as being in possession of drug paraphernalia with intent to distribute a controlled substance for sale. The alleged crimes occurred in Buhler between Jan. 30 and Feb. 3, 2014.

The first count against the two is a level one drug felony with a sentencing range between 11 years and 8 months to 17 years in prison.

Acording to her lawyer Lynn Burke, a search was done without a warrant by Buhler Police Officer William Tracy and the owner of the property. Tracy apparently obtained a search warrant and then confiscated the drug’s plants. The defense contends that they wouldn’t have discovered the marijuana if it wasn’t for what they say was a warrantless search.

A hearing on the issue is scheduled in front of Judge Trish Rose Thursday morning.
