HUTCHINSON, Kan. — After a 56-year-old man entered a plea to two counts of aggravated battery with DUI added to the mix, failing to stop at an accident and felony flee and elude, he is scheduled to be sentenced Friday after a number of delays.
The state dropped one charge against Curtis Cleveland as part of an agreement, that being interference with law enforcement.
Cleveland is guilty of fleeing from a sheriff’s deputy back on June 24, 2014, when he hit a small pickup driven by 26-year-old John Trussell of Hutchinson at the intersection of G and Plum. Cleveland’s vehicle continued to Campbell Street before coming to rest in the yard of a residence there. He then allegedly tried to flee on foot, but was quickly apprehended.
Trussell and his passenger, a 10-year-old boy, were both taken to Hutchinson Regional Medical Center for treatment. A passenger in Cleveland’s vehicle, 37-year-old Nichole Hansen of Wichita, was treated at the scene and released. The state had charged Cleveland over her injuries, however, she failed to show up at the preliminary hearing, so the state dropped that charge.
Assistant District Attorney Andrew Davidson says he will seek jail time in the case, even though the sentencing guidelines call for probation in the case.
The sentencing is scheduled in front of Judge Trish Rose.
