HUTCHINSON, Kan. — After the Kansas Court of Appeals affirmed a decision by Reno County District Judge Tim Chambers to suppress evidence in case against Michael Brisco, the state had sought a review of that decision with the Kansas Supreme Court. That was also denied.
The case has now been remanded for trial and Judge Tim Chambers set a date of Oct. 5 for that to begin.
Brisco is charged with murder in the shooting death of 26-year-old Sem Adrien. Other charges include criminal possession of a firearm, aggravated intimidation of a victim or witness, possession of methamphetamine and solicitation to commit perjury. The shooting occurred back on Sept. 9, 2013.
The judge suppressed statements made by Brisco after the third time he mentioned he was done talking. Twice before he said that, but then started talking again on his own. But, the third time, Police Detective Jamie Schoenhoff initiated the conversation. Deputy District Attorney Tom Stanton had argued that the defendant consented to cooperate with officers during both interviews. The defense contended he may have been under the influence of drugs or alcohol.
Brisco is now represented by Steve Osburn and its unclear how much time he may need to prepare for this trial considering his heavy case load. Stanton says he will be ready for the trial to begin in October.
