HUTCHINSON, Kan. – We’ve talked about it before. For those convicted of stealing from a business two or more times, then steal again, what would normally be a misdemeanor charge becomes a felony, despite how little is stolen.
Case in point, a 27-year-old Hutchinson man appeared before Pro-tem Judge Greg Bell who is filling in for Magistrate Judge Randy McEwen on a theft charge for stealing. The item taken? “Candy.” That’s right, a felony theft charge is what Timothy Luke Foster is facing because he allegedly stole the candy on May 31. That has a sentencing rage of 5 to 17 months in prison.
Foster is also facing charges in a domestic case according to Assistant District Attorney Daniel Gilligan. The charges there are in Hutchinson Municipal Court.
Bell left the bond at $5,000 and the case stolen candy case now moves to a waiver-status docket.
