Judge set hearing in indecent liberties case for possible plea

Etric Jones

HUTCHINSON, Kan. — A man who entered a “not guilty” plea to a single charge of aggravated indecent liberties with a child was scheduled Monday for motions hearing, however they didn’t argue the motions in the case against Etric Jones II. There is word that a plea deal may be in the works, so Judge Trish Rose set a hearing for the day the trial was supposed to begin, that being April 28.

The alleged crime against Jones occurred back on Dec. 13, 2012. The girl, who was 15 at the time, didn’t report the crime until Feb. 1, 2013, which led to the investigation’s beginning.

Jones, who was 18 at the time of the crime, is alleged to have forced the girl into inappropriate sexual relations. She claims that she told him no, while Jones claims she never said that. The two are said to have left school together, parked in an alley and things escalated from there.

The charge as it stands now is a level 3 person felony with a sentencing range between 55 and 247 months in prison.

Prison inmate bound over for trial in stalking case

Monroe Buckner 2

HUTCHINSON, Kan. — A 36-year-old man serving time for a solicitation case out of Johnson County and a criminal threat conviction out of Sedgwick County was bound over for trial on five counts of stalking and five counts of violation of a protection order.

The case against Monroe Buckner here in Reno County involves the same victim in the criminal threat case in Sedgwick County. The victim apparently moved to South Hutchinson to avoid letting Buckner know where she was living.

He apparently attempted directly or through a third party to get a hold of the victim wanting her address so he could supposedly send her a letter. But, the victim testified that she is terrified of Buckner saying, “if he wants to get at me, he’ll find a way.”

He’s alleged to have made the contact with the victim over period of days between Nov. 8 and Nov. 20, 2014, while he was at the El Dorado Correctional Facility.

The defense argued that the charges should be dropped because the victim was in no danger with Buckner in prison.

Because he’s now being held at the prison in Ellsworth, they went ahead and arraigned him on the charges Monday where he entered, “not guilty” pleas.

A pretrial hearing will be held in front of Judge Trish Rose on May 1.

Appeal over suppressed statements in murder case being herd Tuesday

Michael Brisco 2

HUTCHINSON, Kan. — The trial for a Hutchinson man accused of murder is still on hold while the state appeals the decision of Judge Tim Chambers to suppress some of the statements that Michael Brisco made to law enforcement.

Brisco is charged with two alternate counts of murder for the shooting death of 26-year-old Sem Adrien. One is for premeditated first-degree murder and the alternate count is for intentional second-degree murder. Other charges include criminal possession of a firearm, aggravated intimidation of a victim or witness, possession of methamphetamine and solicitation to commit perjury. The shooting occurred back on Sept. 9, 2013.

The judge suppressed statements made by Brisco after the third time he mentioned he was done talking. Twice before he said that, but then started talking again on his own. But, the third time, Police Detective Jamie Schoenhoff initiated the conversation. Deputy District Attorney Tom Stanton argues that the defendant consented to cooperate with officers during both interviews. The defense contended he may have been under the influence of drugs or alcohol.

Stanton will argue the states argument on Tuesday when he appears before the Kansas Court of Appeals with the session in Wichita.

Deron McCoy appeal hearing to be held in Wichita Tuesday

Deron McCoy 2

HUTCHINSON, Kan. — The case against 32-year-old Deron McCoy Jr.. convicted of most of the counts against him involving a standoff with police goes before the Kansas Court of Appeals Tuesday.

The case goes back to March 22, 2011 which started as a domestic dispute when McCoy and the mother of his child were arguing over whether he would give her their child, but also whether she would enter the motel room. McCoy was staying in a room at the Budget Host Inn at 4th & Washington. After repeated attempts to contact him, police officials decided to rush into the room, and McCoy allegedly had a gun pointed in the direction of a woman he calls his sister, and is also accused of using the baby as a shield in front of his head when officers entered. He denies that he ever held the baby to shield himself.

He was sentenced by Judge Tim Chambers to roughly 28-years in prison and his earliest possible release date is in 2035.
