It was back in May when Magistrate Judge Randy McEwen granted a defense request for a mental evaluation on a 25-year-old man accused of severely beating his own mother.
Tuesday, the results were announced that showed that Joseph Lewis Jr., is competent. His attorney Kelly Driscoll agreed to the finding. She had argued to the court in May that she was having trouble getting Lewis to make any decisions on which way this case should go. She says he was so distraught, that he only cried when they tried to discuss the case.
In court, the defendant showed no emotion and a date for the preliminary hearing was set for August 22, at 4:15 p-m in the afternoon.
The state will be seeking an upward departure in this case if he is convicted which means double sentence if convicted on the charge of aggravated battery.
The alleged crime occurred back on January 29.
