Judge Rose set to rule on motions in solicitation case
HUTCHINSON, Kan. — A 55-year-old Hutchinson man charged with electronic solicitation and aggravated violation of the offender registration act is expected back in court Friday where Judge Trish Rose is expected to announce on the record her decision regarding motions filed in the case.
She had taken the two biggest motions involving Steven Peterman under advisement after Defense Attorney Justin Bravi requested that the first count be dropped saying the state failed to prove intent in the case, while the state argues that its a jury decision.
The defense motion of Limine and the states motion to present prior bad acts testimony at trial are kind of mixed. The motion of Limine is basically asking that his prior convictions be excluded at trial, while the state wants it presented believing it would show intent in the current case.
Peterman was arrested back on Feb. 12. 2014 when he was allegedly waiting to pick up an underage girl in the parking lot of the Hutchinson Mall. He is accused of engaging in conversations via cell phone with Sheriff Detective Diana Skomal, who posed as the 15-year-old. He allegedly went to the mall to pick her up with the intention of assisting her in running away from home, but also to teach her sex.
He’s served time in prison for two counts of attempted rape and electronic solicitation of a child from a case in 2001. But, he also has convictions for three counts of theft, perjury and issuing a worthless check. Those cases go back to 1979 and 1980.
As it stands now, the trial is set to begin on March 3, however depending on what her decisions are on the motions, that could be delayed.
Defendant found “Not Guilty” in abuse case back in court on other charge
HUTCHINSON, Kan. — After a jury found a Hutchinson man accused of four counts of abuse of a child “not guilty” Wednesday, he was back a judge Thursday morning where he was read a formal complaint for a charge of possession of methamphetamine.
The case goes back to when he was arrested in the abuse case that Bradley Cole allegedly had 15 empty baggies with meth residue and some syringes. District Attorney Keith Schroeder says they had dropped the charge, then refiled it.
In court, he requested a signature or O.R. bond. But, Assistant District Attorney Andrew Davidson informed the court that he has another case pending for making false writing and two charges of theft by deception, so he thought the $5,000 bond was appropriate.
Cole late Wednesday was found “not guilty” on the abuse counts for allegedly causing severe bruising on the bodies of two boys, a 3-year-old and a 6-year-old. That was back on Aug. 1, 2013. He was arrested on the meth charges on Aug. 6, of that year.
The meth case will now proceed to a waiver-status docket.
