Hutch man granted probation in flee and elude and burglary case
HUTCHINSON, Kan. — A local man arrested for allegedly eluding law enforcement on Nov. 18 of 2013 was granted probation in that case and another when he was sentenced Friday by Judge Joe McCarville.
Christopher Hall in one case was convicted of felony flee and elude, while a charge of disorderly conduct was dismissed. He was also convicted of burglary of a dwelling located in the 500 block of Porter and misdemeanor theft. That case is for a break in on the same date.
For the flee and elude, the judge gave him one year of probation on an underlying one-year sentence. In the burglary case, he was sentenced to two years in prison, but then granted two years probation.
In a traffic case, Hall was convicted of driving while suspended. There is some question of how many convictions that makes. The state claimed it was 10, but the judge counted eight prior convictions. The judge gave him 12 months for that conviction. Normally, the defendant for this many convictions would have to serve a lengthy jail sentence, but Hall had spent five months in jail already, so he went along with the defense request that he be granted time served. However, the fine is pretty hefty at $1,500.
The first case started in the early morning hours when Hutchinson Police responded to a disturbance around 3:30 at the IHOP Restaurant on the east side of Hutchinson. They then tried to make contact with Hall, but he allegedly refused to stop his vehicle and the chase began. It eventually ended on U.S. 50 where he stopped his vehicle and surrendered around 4 a.m. The burglary occurred around that same time.
2 arrested in drug distribution case formally charged
HUTCHINSON, Kan. — The two people arrested last weekend on drug-related charges, after police recovered a reported stolen vehicle, were both back in court Friday for the formal reading of charges.
Thirty-five-year-old Nichole Moore is charged with possession of meth, interference with law enforcement and criminal damage. Twenty-three-year-old Jacob Elzey is now charged with possession of methamphetamine with intent to sell, distribution of amphetamine, possession of alprazolam with intent to distribute, possession of drug paraphernalia with intent to distribute, possession of methamphetamine, personal use drug paraphernalia, interference with law enforcement and criminal damage.
The two were arrested Saturday morning in the 500 block of North Van Buren. Apparently an officer saw them in the vehicle and they both attempted to flee when they stopped the vehicle and broke a fence in the process. Elzey is then alleged to have given a different name to officers.
Both appeared before Magistrate Judge Randy McEwen where they were told of the charges. The cases will move to a waiver-status docket next month. Elzey’s bond remains at $26,000 and Moore’s bond is $15,000, which includes another case pending for felony theft.
Hickey sentenced to 6 months for criminal damage
HUTCHINSON, Kan. — After a Reno County jury found a 22-year-old Hutchinson man not guilty of aggravated assault, but guilty of criminal damage, William Hickey was given six months for that sentence. He’s been in jail for five months, so Judge Chambers ordered he serve one more month on that case.
However he isn’t out of the woods, he still has another case pending in another jurisdiction and is still on community corrections for a previous case.
He was accused of pulling a knife on his father back on June 27 of last year. Hutchinson police were called to the scene on the report of a disturbance and took the report that Hickey had threatened his dad with a black pocket knife. The knife was found in the trunk of a car outside the home, according to police testimony on Tuesday.
Judge Chambers noted that Hickey is still on corrections for aggravated endangerment of a child in one case and attempted criminal threat in another, which also involved his dad. He was given one year on community corrections with an underlying sentence of one year, six months in prison.
