Judge sets preliminary hearing date in solicitation case

Sex Crimes

HUTCHINSON, Kan. — A Hutchinson man was in court Wednesday afternoon where his attorney asked for a preliminary hearing setting.

Bret Herald is charged with a single count of indecent solicitation of a 15-year-old child. The alleged crime occurred between March 1 and June 12, 2014. However, an offer was made in the case and he may have turned that down, so the state indicated that they may file an amended complaint charging him with aggravated indecent liberties with a child. That would make this a Jessica’s law case, meaning a life sentence if convicted. For the current charge, he could be looking at 17 to 46 months in prison if convicted.

Judge Joe McCarville set a preliminary hearing date of March 5. The judge also warned the defendant that the state is under no obligation to offer another agreement. He told Herald that they will talk about that more when the case up for hearing next month.
