Hutch man charged in assault case enters ‘not guilty’ pleas

HUTCHINSON, Kan. — A 33-year-old Hutchinson man who was taken to jail back in November after an altercation where he allegedly pointed and discharged a gun will face trial at this point after he was arraigned Monday.

Nicholas Espinoza is charged with aggravated assault, criminal possession of a firearm, possession of marijuana and drug paraphernalia. He entered “not guilty” pleas to the charges and, as it stands now, will face a jury

He was arrested after Jennifer Rutan told police that he pointed a gun in her direction as she and her husband drove west on a south side Hutchinson street. He is also alleged to have fired the gun at some point. A volunteer officer heard a gunshot while in the area. They reportedly found a spent 40-caliber shell outside the home of Espinoza in the 100 block of East Campbell.

Judge Trish Rose will set a pretrial hearing in the case in the near future.

Espinoza has previous felony convictions for drugs going back to May of 2011 that makes it illegal for him to have any type of weapon.

Hutchinson man charged with injuring infant child arraigned Monday

HUTCHINSON, Kan. — A man accused of injuring a child was arraigned on the charges Monday and entered “not guilty” pleas.

Alexis Silva is charged with reckless aggravated battery as well as two alternate counts of abuse of a child. The theory for the first abuse count includes shaking of the child. The second includes cruel or inhuman corporal punishment. Assuming the case gets all the way to a jury trial, the jury would have to decide which one of the three charges he’s guilty of, or find him not guilty of anything.

The injuries to the child, according to doctors, consisted of a fracture to the left leg of the 3 month old, but also other injuries that included bruising on both cheeks, fractured ribs and retinal hemorrhaging in one eye, which they say would indicate possible shaking of the child.

The crimes charged against Silva are alleged to have occurred some time between August and October of last year.

Judge Trish Rose will now set a pretrial hearing to see where the case is going and if any motions will be filed prior to the trial.

Hutchinson man enters plea in marijuana distribution case

HUTCHINSON, Kan. — A 23-year-old Hutchinson man accused of selling marijuana was scheduled to be arraigned Monday morning, but ended up entering pleas as charged instead.

Christopher Boyd entered pleas to possession of marijuana with intent to sell, possession of drug paraphernalia with intent to package drugs for distribution, possession of marijuana and personal use drug paraphernalia.

The arrest coming after a search warrant was served on a home in the 600 block of West 7th. This is where a blue back pack was found that contained a glass jar with the marijuana. Also found was over $1,600. in U.S. Currency. They also found a pipe with residue, and in his car was a scale with marijuana on it. In all, 18 grams of pot were found. This occurred back on Feb. 22.

With Boyd entering pleas, sentencing in the case will be on Nov. 11.
