Hutch Man found in direct contempt in aggravated assault case
HUTCHINSON, Kan. — The man who made Senior Judge William “Buck” Lyle get angry last week did the same thing to Judge Joe McCarville Wednesday and was found in direct contempt of court.
25-year-old Brandon Brandhorst is charged with two counts of aggravated assault and domestic battery for an incident back on September 20. There is supposed to be a no-contact order with the victim, but he showed up in court last week with the alleged victim thinking that the no-contact order ended then.
He also thought he could get the charges dropped with her not wanting to pursue the case. He came close to arguing with the judge who informed him that he’s lucky he didn’t get thrown in jail because of violating the no contact order. Of course, only the state can decide whether to pursue charges or not.
Wednesday, he angered Judge McCarville when the judge revoked his bond and repeatedly used foul language causing the judge find him in direct contempt and sentenced him to 10 days, that according to Assistant District Attorney Andrew Davidson. The new bond was set at $25,000.
Brandhorst is accused of pulling a knife and a Highpoint 380 ACP handgun and threatening the victim with it. He’s also accused of striking her during the altercation which is reported to have occurred at an apartment in the 600 block of North Maple. But, he argued at previous hearings that that there was never a gun involved.
His criminal case will now move to a waiver-status docket.

Hutch man after altercation with police formally charged
HUTCHINSON, Kan. — The 35-year-old Hutchinson man who is accused of getting into an altercation with police after he took some boots from a local store without paying has been formally charged.
Sonny Bray is accused of aggravated battery of a law enforcement officer, felony theft, battery and interference with law enforcement. He is accused of biting one of the officers as they tried to take him into custody. This occurring at Tractor Supply at 1203 North Lorraine back on September 26. He is also alleged to have battered a woman at the store while all this was occurring.
The aggravated battery count is a level three person felony with a sentencing range of 55 to 247 months in prison, depending on the defendants past criminal history. That may not help Bray much, because he prior convictions for aggravated battery, criminal possession of a firearm, burglary, criminal damage, theft, criminal discharge of a weapon and aggravated weapons violations. Those crimes stretch over a period from 1997 to 2004.
His case now moves to a waiver-status docket on October 14.

Man suspected of torching a trailer formally charged
HUTCHINSON, Kan. — The 41-year-old Hutchinson man arrested for starting a fire in a trailer on the east side of the city now faces formal charges.
Troy Lynn Petz is now charged with arson of a dwelling, possession of marijuana, drug paraphernalia, violation of a protection from abuse order and criminal trespass.
The fire was at a vacant mobile home back on September 23, when Hutchinson fireman responded to the 2200 block of East 4th and found smoke and flames coming from the rear of the trailer. The trailer had no utility service connected and was valued at around $5,000. Fire officials considered it a total loss.
Petz does have a prior conviction for driving under the influence for a Harvey County case going back to 2009.
This case moves to a waiver-status docket on October 29. Petz remains jailed on a $7,500 bond.

Accident leads to arrest for driving while suspended
HUTCHINSON, Kan. — After a pedestrian was struck by a vehicle at 4th & Main Wednesday, the driver of the vehicle was arrested for driving while suspended, no insurance, and inattentive driving.
32-year-old Gwendolynn Fry was apparently attempting to make a left turn onto 4th, from Main when she struck 22-year-old Mark Hoffman. He was not seriously injured and was in the crosswalk when he was struck.
The accident occurring around 10:15 a.m. Wednesday morning.
