Hutch man sentenced to prison in latest drug case

A 26-year-old Hutchinson man sentenced to prison for two years in other cases was sentenced Friday to a total of just over two years in a case involving possession of drugs.

Jacob Henson was sentenced to two years, four months for convictions of possession of methamphetamine, possession of marijuana with a prior conviction, possession of oxycodone, possession of a controlled substance with a prior conviction, possession of personal use drug paraphernalia and interference with law enforcement.

His attorney, Alice Osburn asked for a downward departure to corrections saying the case falls into a border box, while the state objected saying there is no substantial and compelling reason to do so.

Henson admitted in court he has a drug problem and wants help. He told the judge about the classed he’s taking in prison to change his life. He also told of his three kids and says he can’t raise them in prison. Judge Chambers says Henson working to change his life is encouraging, but says he couldn’t find a reason to depart and grant community corrections.

He was arrested back on October 15, 2013 in the 100 block of West 12th on a warrant for failing to appear on the theft charge. He was apparently uncooperative with law enforcement leading to him being tased. They then allegedly found drugs on his person.

Henson is already serving two years in prison for two other cases. One is for getting into a fight inside the county jail back on June 19, 2013 and that other involves convictions for possession of methamphetamine, possession of marijuana with a prior conviction, two counts of possession of prescription drugs, both with a prior convictions and possession of drug paraphernalia. All of the drug crimes occurring back on March 7, 2013.

Judge Chambers had earlier sentenced him to the two for the aggravated battery conviction, then ran all the drug case sentences concurrent to that. Friday, he ordered the new sentence concurrent to the one he received in the other cases.
