Defense wants evidence and statements suppressed in meth case

HUTCHINSON, Kan. – A Reno County man arrested back in March of last year for allegedly manufacturing methamphetamine now wants some of the evidence in the case suppressed.

Jeffrey Hamilton is charged with manufacture of methamphetamine or in the alternative attempted manufacture of meth, possession of anhydrous ammonia, lithium metal, ephedrine and drug paraphernalia all with intent to manufacture meth. He’s also charged with possession of anhydrous ammonia in an unapproved container.

His Wichita attorney Charlie O’Hara wants statements suppressed claiming his client was under the influence of drugs at the time he was questioned by law enforcement this after he was taken into custody. O’Hara says his client didn’t waive his rights and didn’t understand those rights under Miranda.

The defense also wants items found during the search of his home suppressed saying the information mentioned in the law enforcement affidavit doesn’t rise to the level of probable cause. He also states in his motion that some of the information in that affidavit is old, some coming from information of criminal activity from October and July of 2010 and May of 2012.

O’Hara also alleges that the affidavit contains no mention or any evidence of any controlled substance other then methamphetamine or anything items used to manufacture methamphetamine.

The case begins when the Reno County Drug Enforcement Unit served a search warrant on the property at 7101 Pony Acres Road and Hamilton was the only one present. He was allegedly in the process of making meth when the search began. He was allegedly three fourth’s of the way from being complete and ready to go through what they call the “gassing process.”

A hearing in front of Judge Tim Chambers was scheduled for Wednesday but was continued at the request of O’Hara. He is apparently busy with a case in Sedgwick County District Court, so a hearing on the motions will come at some later date.

Hamilton is currently free on bond.
