Local man granted another break in abuse case

HUTCHINSON, Kan. — After Judge Tim Chambers imposed a 60-day sanction for a 25-year-old man convicted of a single count of abuse of a child as part of his corrections, Cody Hazard was back in court for the judge to reconsider the terms of the sanction.

Hazard was sentenced to 10-years, 8-months in prison, but was then granted three years probation. However, he was ordered to serve 60-days in the Reno County jail as part of those corrections. His attorney, Sarah Sweet McKinnon asked Friday that he be allowed to serve the final 30-days on weekends, something the judge said he would consider after the defendant served at least 30-days. She cited that fact that he would like to go back to work.

Senior Assistant District Attorney Steve Maxwell noted that the judge already granted a departure in the case and that the defendant has a criminal history score of “A.” He told the judge that the state was opposed to any modification.

But, Judge Chambers went beyond what even the defense was asking for and will allow Hazrad to be released from jail once house arrest can be set up. That could happen as early as next Monday.

Hazard was convicted of causing severe bruising to the bottom of a 3-year-old boy on November 14, 2012. Police say it was caused by using excessive force when spanking the child.

Police got involved after they were notified by a daycare provider when the child was going to the bathroom and told them of what he called “ouchies” on his bottom.

Judge Tim Chambers agreed to the downward departure in the case over the objection of the state.

Hazard in a separate matter has charges associated with a hit-and-run accident.
