A 26-year-old Hutchinson man accused of two counts of aggravated battery, aggravated assault and aggravated endangerment wanted his case dismissed, however after hearing evidence of the incident last summer, Judge Tim Chambers decided that the issues involved in the case should be decided by a jury.
Mitchell Stahl is alleged to have backed into a woman and her child with his vehicle and also threatened her with a baseball bat. The whole thing started with Stahl getting into an argument with the victim, Tisha Crile. This started after she claims saw him being abusive to a young child. The alleged crimes occurring on the parking lot of Walmart back on July 4, 2013.
One of the alleged victims in the case as well as the defendant both took the stand Thursday morning and told of what happened. After hearing their statements, Judge Chambers avoided giving his personal feelings, but indicated that he thought plea negotiations should be done with this case.
Stahl’s attorney filed a motion to dismiss the case contending that Crile placed her shopping cart directly behind the defendants car and after Stahl asked her to move it and she refused he started backing up and struck the shopping cart and Crile. Neither were injured as a result. The defense contended that she violated his “liberty” when she got involved with him because she was not a law enforcement officer, nor a security officer for Walmart. They wanted Stahl to be granted immunity from prosecution and have the case dismissed.
As it stands now, the case will move to a jury trial next month.
