For the second week in a row, the sentencing hearing for a 38-year-old Hutchinson man found guilty of attempted rape, aggravated indecent liberties with a child and aggravated criminal sodomy has been continued. The hearing for Henry “Harley” Davidson had been scheduled once again for Friday.
The defense apparently wants time to file motions prior to sentencing and the continuance was granted by Judge Tim Chambers.
Davidson faces prison time for molesting the 10-year daughter of a Hutchinson woman he was living with. The sexual abuse occurring in a time period between October of 2010 and September of 2012. At least that’s when the defendant lived with the alleged victim and her mother.
The victim alleges she was tied up with string when the inappropriate sexual encounters occurred. She alleges that it would occur as much as once a week. The child, now 11 also alleged that he took a picture of her with his cell phone. The state presented the pornographic photo of the child found on his cell phone to the jury during the trial.
The state had actually charged Davidson with rape, however, the jury decided on the attempted rape count against him instead. But, the attempted rape conviction and the other two fall under Jessica’s Law meaning he could be sentenced to multiple counts of life in prison with no chance of parole for 25-years on each count.
