Michael Briscoe 2

A Hutchinson man bound over on a charge of first degree murder was in court Friday for a pre-trial hearing where Judge Tim Chambers asked his attorney if there are any plea negotiations occurring with the state. Alice Osburn who represents Michael Brisco told the court that her client is not interested in any plea, in other words, he wants to take his chances with a jury.

Brisco is charged with two alternate counts of murder for the shooting of 26-year-old Sem Adrien back on September 9, 2013. One is for premeditated first degree murder and the alternate count is for intentional second degree murder. Other charges include criminal possession of a firearm, aggravated intimidation of a victim or witness, possession of methamphetamine and solicitation to commit perjury.

The alleged crimes occurring after Adrien may have been rude to Brisco’s girlfriend and the two began to fight inside Brisco’s home. The shooting occurring outside with the victim collapsing on a nearby parking lot near 8th & Plum.

Judge Chambers had already set a tentative trial date for May 5 and that will stand for now. Friday, he set a motion deadline of April 15. Both sides anticipate filing motions in the case prior to trial meaning there will be a motion hearing scheduled at some point prior to trial beginning.
